A purchase from the Beat Store on Thundabeats.com grants you the right to use our instrumental(s) in any way you see fit, within the terms outlined below. Whether you’re leasing one of our beats or purchasing Exclusive Rights, a copy of the appropriate agreement will be included in your download. Have fun!
STANDARD LEASE – TERMS OF AGREEMENT
This is a License agreement between the “Producer” (Thundabeats) and the “Licensee” (You). By making a purchase on Thundabeats.com, you acknowledge a full understanding of these terms and agree to abide by them. Please read them carefully.
You will receive a copy of your instrumental(s) in MP3 (192 kbps) or WAV format (16bit 44.1khz). The file will be delivered electronically through email to the address associated with your PayPal account (or the email address you used to sign up on our site). This agreement allows you to use the provided instrumental(s) for ONE commercial recording or broadcast (each). Any additional use(s) require the purchase of an additional Lease.
You have full rights to record, alter, mix the instrumental in any shape, way, or form (except reselling the instrumental). You may use the instrumental for non-profit promotional use, demos, or sites such as YouTube. Your recording can also be distributed by you at any price up to 10,000 units sold. The Producer will not receive a royalty from your sale of records or downloads, except for ad revenue automatically collected on our behalf. You must however give full credit to the Producer on all commercial recordings, where applicable and appropriate, e.g. “Prod. by Thundabeats”.
In the event a third party buys Exclusive Rights to a beat you have leased, your rights still remain for up to six (6) months from the date Exclusive Rights were purchased. The beat is still yours to use during that time, but you may not upgrade to Exclusive Rights once they have been purchased by a third party.
Upon Licensee’s purchase of Leasing Rights, you understand the Producer owns full rights to the beat(s) and is able to resell the beat(s) to any other party.
EXCLUSIVE RIGHTS – TERMS OF AGREEMENT

This agreement is made by and between Eric W. Brown (a.k.a. “Thundabeats”) and the Licensee, for the exclusive, non-transferable right to use the musical composition known as (the “Composition”) for all commercial recording, performing, broadcasting and distribution purposes (“Exclusive Rights”).
This license permits the exclusive use of the Composition or any portion thereof in particular recordings made in connection with the Composition, including the exclusive right to perform, broadcast and distribute any derivative thereof. This license is non-assignable and any attempt to reproduce, share or re-sell the Composition itself is strictly prohibited.
The Exclusive Rights are granted for and in consideration of the Price written above, receipt of which is hereby acknowledged.
Unless otherwise agreed in writing, Thundabeats offers the Composition as-is and makes no representations or warranties of any kind concerning the work, including, without limitation, warranties of title, merchantability, fitness for a particular purpose, non infringement, or the absence of latent or other defects, accuracy, or the presence or absence of errors, whether or not discoverable.
Royalties for the sale, distribution, broadcast and performance of any derivative of the Composition shall be allocated as follows:

50% – Licensee –
50% – Publisher – Hammertraxxx Music (SESAC)
50% – Licensee –
All distributed works must credit Thundabeats where applicable, and where possible, must also link to http://thundabeats.com
LIMITATION ON LIABILITY
Except to the extent required by applicable law, in no event will Thundabeats be liable to Licensee on any legal theory for any damages arising out of this license or the use of the Composition, even if Thundabeats has been advised of the possibility of such damages.
This License and the rights granted hereunder will terminate automatically upon any breach by Licensee of the terms of this License.
